Abstract
This study analyzes the constitutional guarantees applicable to domestic animals in Ecuador, identifying their normative scope and practical effectiveness. A qualitative methodology was used based on documentary and comparative analysis of the 2008 Constitution, the Organic Code of the Environment, Sentence No. 253-20-JH/22, and international animal welfare standards. The findings show that, although the legal system recognizes animal sentience and establishes principles of protection derived from the rights of nature, there is no express recognition of domestic animals as subjects of rights or specific procedural mechanisms for their defense. The main gap identified lies in the lack of coordination between constitutional recognition, secondary legislation, and its institutional implementation. It is concluded that the effectiveness of guarantees depends on comprehensive regulatory reforms and the strengthening of public policies and enforcement mechanisms.
