Abstract
Obstetric violence is a social and structural problem that has been made invisible and that affects the quality, integrity, dignity and guarantee of patients' rights. To understand medico legal responsibility in cases of obstetric violence through comparative constitutional analysis. Interpretive and analytical study, of mixed qualitative and legal design, using the dogmatic and hermeneutical method. It is determined that obstetric violence is a common public health problem that limits the guarantee of rights in patients, there are differences in the level of recognition in the countries analyzed. Differences were identified in the determination of medico legal liability. Venezuela and Argentina reflect progress in the classification and formal recognition of obstetric violence as a crime, contemplating sanctions based on the level of responsibility. Ecuador and Bolivia maintain legal loopholes that limit the identification of medico legal responsibility and sanctioning, preventive or reparative action.
